Aaron J. Foxworthy

Mr. Foxworthy counsels public and private clients on questions of land use and natural resources law.  His practice focuses on advising property owners, developers and other stakeholders on obtaining and defending federal, state and local entitlements and approvals for commercial, residential and mixed-use projects.

Mr. Foxworthy has advised clients on myriad aspects of the land entitlement process in California.  He has substantial experience counseling clients on compliance with wetlands and stormwater regulatory programs administered under the Federal Clean Water Act and water quality regulation under the state Porter-Cologne Act and Water Code.  He has also advised clients on listing and critical habitat decisions and incidental take authorization procedures under the Federal and California Endangered Species Acts, as well as other special status-species and habitat protection programs administered by state and local regulatory entities, including Fish and Game Code § 1600 (California Lake and Streambed Alteration Notification program).

Mr. Foxworthy has advised clients on development within the respective jurisdictions of the California Coastal Commission and San Francisco Bay Conservation and Development Commission, and has worked with property owners and state and local trustees on the unique issues faced by owners and potential developers of lands encumbered under the state's public trust doctrine.

Mr. Foxworthy has counseled clients on compliance with the procedural requirements of the National Environmental Policy Act as well as substantive and procedural requirements of the California Environmental Quality Act in conjunction with obtaining federal, state and local permitting actions for private projects.
